National Impaired Driving Prevention Month

December marks the holiday season.  It is a time for celebrating with family and friends.  Often, holiday parties and celebrations involve alcohol. 

Consequently, December is also National Impaired Driving Prevention Month. The White House, the Office of National Drug Control Policy, and the National Highway Traffic Safety Adminstration (NHTSA) have teamed to observe this effort to combat drunk driving, drugged driving, and distracted driving.

According to NHTSA data, in 2010:

While consumption of beer, wine, and other spirits is not limited to the holiday season, an increase in alcohol misuse and abuse is often observed.

The penalties for driving under the influence of alcohol, marijuana, or other drugs are severe in Pennsylvania.

From a general standpoint, the consequences for a DUI conviction (by guilty verdict or plea) are tied to the presence and/or amount of drugs or alcohol in a person's blood or breath, as well as the number of prior DUI convictions.  Absent a not guilty verdict or entry into a pretrial diversion program, even a first-time offender will face mandatory jail time, a mandatory driver's license suspension, and mandatory fines.

Where an accident and personal injury to another vehicle driver or passenger occurs, the penalties increase substantially.  A person charged with offenses like Aggravated Assault by Vehicle While DUI or Homicide by Vehicle While DUI can face a significant state prison sentence.
