GOT DRUGS?

National Prescription Drug Take-Back Day is scheduled to take place on Saturday, October 26, 2013, from 10:00 a.m. to 2:00 p.m.  This serves as opportunity for people to safely discard unused or expired prescription drugs.

Help Fight Prescription Drug Abuse

By seizing this opportunity to get rid of unwanted prescriptions, you do your part to help prevent or curtail prescription drug abuse.

Like any crime, the unlawful diversion of a prescription is a result of motive and opportunity.  For a person battling drug abuse, the desire to feed their addiction is the motive.  However, without access to drugs, the opportunity to abuse them is reduced.

Drugs and Crime

When drugs get a unyielding grasp on a person's life, contacts with the criminal justice system often result.

The possession of drugs alone can lead to criminal consequences.  Where a person obtains or attempts to obtain a prescription drug by fraud, forgery, or alteration of prescription order, the possession or attempted possession of the drug could result in criminal charges under either the Pharmacy Act or the Controlled Substance, Drug, Device, and Cosmetic Act in Pennsylvania.

Fraudulent actions taken in an effort to unlawfully secure a prescription could also result in charges under the PA Crimes Code, like Forgery or Identity Theft, depending upon the specific circumstances in a case.

A person could also be charged with Drug Possession or Possession with Intent to Deliver depending upon the quantity or number of pills they illegally possess.

Moreover, a person with an identifiable drug problem may be charged with indirect crimes resulting from a desire to feed their addiction.  Examples of such charges may include:  Drug Delivery, Burglary, Theft, or Access Device Fraud.
