Prescription Drug Crime Crackdown for York County, PA

The York County Office of the District Attorney has been awarded grant money to fight the illegal use of prescription drugs.  This money is expected to be used for aggressive enforcement of prescription drug crime violations.

Prescription Drug Abuse on the Rise

Throughout Central & South Central Pennsylvania in areas like Hershey, Middletown, Mechanicsburg, and Gettysburg, prescription abuse and addiction has increased.  While not unique to its geography, the criminal prosecution of prescription drug charges has significantly risen over the last couple years in York, PA.

Many people experiencing prescription drug abuse or addiction problems had begun their use legally.  Often, people gain access to prescription narcotics, for example, as part of a pain management plan for back or neck injury.  Over time, some people become consumed by the feeling, release, or outlet the effects of the drug provide them.  This can become the unfortunate beginning to a downward slide that leads to a person being charged with a prescription drug offense.

Prescription Drug Crime & Pharmacy Act Violations

In Pennsylvania, a person could be charged with a prescription drug crime under either the Pharmacy Act or the Controlled Substance, Drug, Device, and Cosmetic Act. 

While the Controlled Substance Act is what drug crimes involving marijuana, heroin, or cocaine are prosecuted under, illegal possession of prescription drugs can also fall within its scope.  Meanwhile, the Pharmacy Act specifically targets the possession or acquisition of prescription drugs by fraud with a more limited scope. 

In both instances, the illegal possession of narcotic prescription drugs, such as, oxycodone, will trigger an enhanced grading as a Felony, as opposed to a Misdemeanor.  As a result, the penalties the person accused can face also increase.

Additionally, under the Controlled Substance Act, a person could be charged with Felony Delivery or Possession With Intent to Deliver prescription drugs depending upon the circumstances present in the case.  If charged under these circumstances, a person could possibly face a mandatory minimum prison sentence based upon the weight or location of the sale or possession with intent to sell among other factors.
